GDS Cumbria Limited terms and conditions

Definitions
1.1 ‘Buyer means the person whose name and address appears in the space marked ‘Bill To’ overleaf.
1.2 ‘Conditions’ means the terms and conditions of the sale set out in this document and any special terms and conditions agreed in writing by the Seller.
1.3 ‘Delivery Date’ means the date specified by the Seller the goods are to be delivered.
1.4 ‘Goods’ means the articles which the buyer agrees to buy from the Seller.
1.5 ‘Price’ means the price for the goods excluding carriage, packaging, insurance and VAT.
1.6 ‘Seller’ means GDS Cumbria Limited, Clint Mill, Cornmarket, Penrith, United Kingdom, CA11 7HW
Conditions applicable
2.1 These Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions including any terms or conditions which the buyer may purport to apply under any purchase order, confirmation of order or similar document.
2.2 All orders verbal or written for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these conditions.
2.3 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s order and acceptance of these Conditions.
2.4 Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
The Price and Payment
3.1 The price shall be the price set out on the quotation sheet. The price is inclusive of VAT, at the rate ruling on the date of the Seller’s invoice.
3.2 Interest on overdue invoices shall accrue from the date when payment become due from day to day until the date of payment at a rate of no more than 3% above Bank of England base rate (annual equivalent) per month and shall accrue at such rate after as well as before any judgement.
The Goods
4.1 The quality and description of the Goods shall be as set out as per quotation.
Warranties and Liability
5.1 The Seller warrants that the Goods will at the time of delivery correspond to the description given by the Seller. Except where the Buyer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977 Section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or condition of the Goods and whether implied by statute or common law or otherwise are excluded.
Delivery
6.1 Unless otherwise agreed with the Seller, the Goods shall be delivered to the Buyer at the Buyer’s address.
6.2 In any other case delivery of the Goods shall be made to the Buyer’s address on the delivery date. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
Cancellations
7.1 Consumer contracts may be subject to the cancellation provisions of the Consumer Contracts Regulations 2013 - where applicable.
Electrical Recycling
8.1 You can now recycle your old electricals with us.
If you’re buying a new electrical item, we will recycle your old one for free
8.2 Why recycle?
Unwanted electrical equipment is the UKs fastest growing type of waste.
Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination harming wildlife and also human health.
8.3 We can help
We are pleased to offer our customers the chance to recycle their old electrical items. To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed out wheeled bin symbol) in your bin.
8.4 What is WEEE?
The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis.

Dispute Resolution
9.1 Either call us on 01768 870208, or write to us at GDS Cumbria Limited, Clint Mill, Cornmarket, Penrith, United Kingdom, CA11 7HW, or email us at gdscumbria@yahoo.co.uk and we aim to respond within 7 days of receiving your complaint and where possible, will provide you with a date to remedy any issues raised. 9.2 Alternative Dispute Resolution (ADR)
Where we are unable to resolve your complaint using our own complaints procedure, as a Which? Trusted trader we use Dispute Resolution Ombudsman for dispute resolution. In the unlikely event that we cannot remedy your complaint to your satisfaction you may wish to refer your complaint to them. If you wish to do so please contact Which?
